What a Compliant Opt-In Actually Contains
Four elements should be visible at the point of consent, with none of them buried in a linked policy.
The first is the identity of the brand sending the messages. The second is the type of messages being sent, described clearly as marketing rather than simply as updates. The third is a statement that consent is not a condition of purchase.
The fourth is the operational disclosure: message and data rates may apply, message frequency varies, reply STOP to cancel and HELP for help, with links to the terms and privacy policy.
A working example for a pop-up could read:
“Get early access to drops. Enter your number to join [Brand] texts. By submitting you agree to receive recurring automated marketing texts from [Brand] at the number provided. Consent is not a condition of purchase. Msg and data rates may apply. Msg frequency varies. Reply STOP to cancel, HELP for help. Terms and Privacy Policy.”
That paragraph is not decoration. It is the artefact you produce if consent is ever challenged, and it needs to be captured with a timestamp against the profile, not just displayed.
Four Placements That Actually Collect
The first is a pop-up with a two-step flow. Ask for email first, then the phone number on the second step. Asking for both at once can suppress both.

The second is the checkout consent line. This is one of the highest-intent moments available, yet many brands still rely on a pre-ticked box. That pattern can undermine consent. The box should be unticked and should carry its own disclosure.
The third is the keyword opt-in. A short phrase on packaging, in a footer, or inside an email, such as “Text JOIN to [number],” works particularly well for brands with physical products. It also creates a clean consent record because the subscriber initiated the action.
The fourth is the back-in-stock or waitlist moment. This is one of the highest-intent capture opportunities on the site because the shopper is explicitly asking to be interrupted. Pair it with back-in-stock alerts.
The Mistakes That Void Consent
Common mistakes include pre-ticked boxes, bundling SMS consent into a single checkbox with email consent or terms acceptance, buying or importing a list from another brand or region, and adding numbers collected for transactional purposes to a marketing programme.
Another mistake is treating old consent as current after a long period of silence.
This deserves attention because it often looks harmless. A number collected two years ago from a shopper who has never responded may still exist as a legal record, but it is attached to someone who may no longer remember the brand. That is where complaints can begin.
